Vineyard Payment, Billing, Cancellation & Refund Policies

This policy includes, but is not limited to,  (i) Users financial responsibility for services, (ii) information about the Subscription Fee and non-covered services, (iii) the cancellation policy, and (iv) the consequences of non-payment, including collection actions and associated fees.

Capitalized terms not otherwise defined in this Policy have the same meaning as set forth in Vineyard’s “Terms and Conditions”, which are incorporated herein by reference.

1.  Notice of Financial Responsibility for Services

Users of the Service authorize Vineyard to charge a chosen payment method (“Payment Method”) for the Services provided. If that Payment Method is invalid at the time payment is due, users agree to pay all amounts due upon demand. The third-party services provider who manages the Payment Method may impose terms and conditions on you, which are independent of these Terms.  Vineyard reserves the right to correct any billing errors or mistakes even if payment has already been requested or received. 

2. Subscription Fee

Services and products available for purchase through the Platforms require that users purchase the product on a subscription basis, which means that the payment will be automatically charged at regular intervals until the subscription is cancelled in accordance with these Terms. Subscription fees, including membership enrollment fees, are not a covered benefit under most health insurance plans or other third party payment plans such as a Health Savings Account or Flexible Spending Account. As a result, you may not be able to submit such subscription fees for coverage under  insurance or other third party payment plans, and as such, will be responsible for the cost of my subscription fee. To the extent permitted by law, subscription fees are final and non-refundable unless expressly stated otherwise.

Vineyard reserves the right to issue refunds or credits at our sole discretion. If a refund or credit is issued in one instance, Vineyard is under no obligation to issue the same refund or credit in the future. If Vineyard terminates a subscription for non-payment, or if you choose to cancel a subscription and return to the program at a later date, you will be subject to any rate increases at the time of re-enrollment. Subscription fees for some users may be different from the subscription fee paid by others using the Services because of discounts or promotions offered to others for which you may not be eligible or which are not available at the time you signed up for the Services.

3. Cancellation Policy

Users and/or Vineyard may terminate or cancel a subscription for Services at any time and for any reason. Users can cancel a subscription at any time by contacting the customer support team at hello@joinVineyard.com. The cancellation will be effective within 30 days.

Upon cancellation or termination of a subscription for Services, Vineyard will deactivate access to the Platform within 30 days and access to Providers and prescription medication will be suspended at that time. Users are encouraged to plan accordingly to ensure that my access to any prescription medication is not interrupted as a result of the cancellation. 4. Non-Covered Services

Subscription fees do not include the cost of medications. Any additional costs for medications will be the  financial responsibility of the User.  

Personal Health Insurance Plans (“my Plan”) may not cover all healthcare costs. Non-Covered Services shall refer to products or services provided, Labs or Pharmacies that are not covered by the Subscription. If any Lab or Pharmacy does not participate in a User’s Insurance Plan, or if the Plan does not cover the charges for additional non-covered services, whether in full or in part, users will be financially responsible for any portion of the cost of services not covered by the Subscription. 

Users are personally responsible for any costs not covered by the Subscription or their Health Insurance Plan or that exceed my benefit limits, including, but not limited to:

  1. all medications;
  2. durable medical equipment;
  3. medical supplies;
  4. laboratory assessments; or
  5. medications, services or supplies that your Plan determines are experimental or investigational or are not covered for some other reason, or that are not medically necessary but that you want to receive.

From time to time, Vineyard may present Users with a choice of certain laboratory services and their costs, which are not included in my Subscription Fee. By purchasing such laboratory services, you will pay the preferred Lab vendor for their services. Users can choose to submit a claim to my Personal Health Insurance Plan or purchase laboratory services on a self-pay cash basis instead of utilizing health insurance benefits. Vineyard is not responsible for any additional costs associated with obtaining laboratory assessments. 

Users are responsible for understanding Health Insurance Plan benefits and are responsible for asking about them before products or services are provided. Neither Vineyard nor the Providers make any representations whatsoever that any fees are or are not covered by User’s Personal Health Insurance Plan.   

5.  Payment and Collections

Vineyard accepts credit and debit cards issued by U.S. banks. If a credit card account is being used for a transaction, Vineyard may obtain pre approval for an amount up to the amount of the payment. User’s will be enrolled in recurring payments automatically and all charges and fees will be billed to the credit card the User designates during the setup process. To change payment methods or designate a different credit card, Users must change this information themselves online.  

In the event of non-payment, Vineyard or its designated agents may access consumer credit reports to help collection efforts. In the event any collection action is necessary to collect amounts owed to Vineyard, Users will pay all expenses associated with such action, including but not limited to collection agency fees and attorneys’ fees. 

Vineyard reserves the right to charge any outstanding post-claim balances to the payment method on file. An invoice will be provided post-claim, with payment due within 15 days, at which point if payment has not been made yet, the card on file will be billed. If payment is unsuccessful, Users will have an additional 30 days to resolve the balance before the subscription is terminated pursuant to the Terms of Service. Notification, where provided, is for user convenience and does not constitute an obligation on Vineyard’d part. You agree that any post-claim balances due will be processed automatically, unless you contact Vineyard’s support team to address any outstanding payment concerns prior to processing.  

6. Agreement and Consent

User’s will be required to agree to the Payment and Billing Consent Agreement and acknowledge financial responsibility prior to receiving services and I consent to the use of credit or debit card for payment transactions.
